Types of Protective Orders
- No-Contact Order (NCO): This type of order is issued only in connection with a criminal case when a defendant has been arrested and charged with a domestic abuse assault crime or any other public offense where the victim has been physically, emotionally, or financially harmed. If the defendant pleads guilty or is found guilty, the judge may put the NCO in place for a longer period of time, depending on the charge and circumstance.
- Civil Protective Order: This type of order is civil, not criminal, and can therefore be issued even if a criminal case is not pending. Victims of domestic abuse can request a civil protective order against a present or former spouse; boyfriend or girlfriend; against the unmarried co-parent of a shared child; against a person living in your household or who lived with you in the past; or against a relative. The court may also assign temporary custody of your children to you in connection with this order.
